1. Scope & Acceptance

1.1. These Terms & Conditions (“Terms”) govern your access to and use of the Site and your purchase of products (“Products”) from Kaya Ceramics AB (“Kaya Ceramics”, “we”, “us”, “our”).
1.2. By placing an order, creating an account, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms.
1.3. You must be at least 18 years old and have the legal capacity to contract. If you purchase on behalf of a company, you represent that you are authorised to bind that company.
1.4. Consumer law: If you are a consumer residing in Sweden or elsewhere in the EU/EEA, mandatory consumer protection laws apply in addition to these Terms, including (for Sweden) the Distance and Off-Premises Contracts Act (Distansavtalslagen) and the Consumer Sales Act (Konsumentköplagen). Nothing in these Terms limits your statutory rights.


2. About Kaya Ceramics & Our Products

2.1. Handmade nature. Our ceramics are handmade in Portugal, fired at approx. 1250°C, and hand-painted. Variations in colour, glaze, thickness, brush strokes, and minor dimensional differences are normal and part of the product’s character. Such variations do not constitute defects.
2.2. Food & use. Products are food-safe, dishwasher-safe and microwave-safe unless stated otherwise on the product page or care card. Not oven-safe.
2.3. Care. Avoid thermal shock (e.g., moving hot items directly into cold water). Use non-abrasive detergents.
2.4. Images & displays. We strive to present colours and details accurately. However, your device settings and ambient light can affect appearance; minor differences between photos and delivered items may occur.
2.5. Availability. We may limit quantities, discontinue items, or change specifications without prior notice. If we cannot fulfil your order, we will cancel (in whole or part) and refund any amounts paid for the unavailable items.


3. Account Registration

3.1. You may checkout as a guest or create an account. Account information must be accurate, complete, and kept up-to-date.
3.2. You are responsible for safeguarding your login credentials and for all activities under your account. Notify us immediately of unauthorised use.


4. Orders & Contract Formation

4.1. Order process. After you place an order, you will receive an acknowledgement email. This is not acceptance. A binding contract is formed when we send an order confirmation email or when we ship the Products—whichever occurs first.
4.2. Right to refuse. We may decline or cancel an order (e.g., pricing error, suspected fraud, delivery restrictions). If payment was taken, you will be refunded.
4.3. Order changes. Once placed, orders may be difficult to modify. Contact us promptly; we’ll try to help but cannot guarantee changes.


5. Pricing, Taxes & Currency

5.1. Prices. Prices are shown on the Site and, unless stated otherwise, are inclusive of VAT for EU deliveries. Shipping fees are shown at checkout or on our Shipping page.
5.2. Currency. Display currency may vary by region; your payment provider may charge conversion or foreign transaction fees.
5.3. Errors. We take care to ensure pricing accuracy; if a material pricing error occurs, we may cancel the order and refund you.
5.4. Non-EU deliveries. Local duties, taxes, brokerage or import fees (if any) are your responsibility and are not included in our prices unless explicitly stated.


6. Payments

6.1. We accept the payment methods displayed at checkout (e.g., card providers, Klarna, PayPal, etc.). Providers are independent third parties; their separate terms apply.
6.2. Security. Payments are processed through secure, PCI-compliant gateways. We do not store full card details.
6.3. Reservation / charge. Depending on method, your payment may be authorised on order and captured on shipment, or charged immediately.
6.4. Ownership. Title to Products transfers upon full payment and delivery.


7. Shipping, Delivery & Risk

7.1. Delivery options, estimated timelines and costs are stated at checkout and in our Shipping Policy. Times are estimates and not guaranteed; external factors (customs, carrier delays, peak seasons) can affect delivery.
7.2. Risk & title. Risk of loss passes to you upon delivery to the address provided (or upon handover to your nominated carrier if you arrange your own shipping).
7.3. Receipt. Please check parcels on delivery. If a parcel is visibly damaged, note this with the carrier and document with photos.
7.4. Refused/undeliverable parcels. If a parcel is returned to us due to incorrect/insufficient address, repeated delivery attempts, or refusal, we will refund the item price (less shipping and any return costs) unless caused by our error.


8. Right of Withdrawal (EU/EEA Consumers)

8.1. Cooling-off period. You have a legal right to withdraw from the purchase within 14 days from the day after you (or a person you nominate) receives the Products.
8.2. How to exercise. Notify us within 14 days using a clear statement (email is fine) or use the Model Withdrawal Form in Appendix A. You must then return the Products within 14 days of notifying us.
8.3. Condition of goods. You may handle items to establish their nature, characteristics and functioning (as you would in a shop). Any diminished value resulting from handling beyond that is your responsibility and may reduce your refund.
8.4. Returns cost. Unless otherwise stated or we are at fault, you bear the direct cost of return shipping.
8.5. Refunds. We will refund the product price and the standard outbound shipping cost (if charged) within 14 days of receiving the returned Products or proof of return. We may deduct for any loss in value.
8.6. Exclusions. The right of withdrawal does not apply to personalised or custom-made items, sealed goods not suitable for return for health/hygiene reasons once unsealed, or goods that after delivery are inseparably mixed with other items.


9. Returns, Exchanges & Damaged Items

9.1. Our Returns & Refunds Policy forms part of these Terms.
9.2. Damaged/incorrect items. Contact us within a reasonable time (preferably within 48 hours of delivery) with photos and your order number. We will repair, replace, or refund as appropriate. Keep the packaging until we advise otherwise.
9.3. Exchange. Exchanges are subject to stock availability; otherwise, we’ll process a refund and you may place a new order.


10. Statutory Warranty (Conformity) – Sweden/EU

10.1. For consumer purchases, you have statutory rights if an item is faulty or non-conforming. In Sweden, you may complain about original defects within three (3) years from delivery (reklamationsrätt).
10.2. If an item is defective, contact us promptly. We will, at our cost and within a reasonable time, repair, replace, or refund (price reduction or rescission) according to applicable law.
10.3. The above does not cover normal wear, misuse, failure to follow care instructions, or variations inherent to handmade products (see 2.1).


11. Gift Cards, Promotions & Bundles

11.1. Gift cards (if offered) are valid for the stated period, non-refundable and not redeemable for cash, except where required by law. Treat as cash; lost or stolen cards will not be replaced.
11.2. Promotions/discounts are subject to their specific terms. We may withdraw or modify offers at any time, within legal limits.
11.3. For bundles or multi-buy offers, returns may require returning all items in the bundle; failing that, refunds may be adjusted to reflect the kept items at full price.


12. Use of the Site

12.1. You agree not to misuse the Site or attempt to interfere with its security or proper functioning.
12.2. Content on the Site, including product descriptions, photos, text, graphics, logos and trademarks, is owned by or licensed to Kaya Ceramics and protected by IP laws. You may not copy, distribute, or create derivative works without our prior written consent.
12.3. Reviews & UGC. If you submit reviews, photos or other user-generated content, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to use, reproduce and display such content for marketing and operational purposes. You remain responsible for ensuring you own the rights and that the content is lawful and not misleading.


13. Sustainability & Packaging

13.1. We aim to minimise plastic use in packaging where feasible while ensuring adequate protection during transit.
13.2. Packaging materials may vary by shipment to ensure safety and compliance with carrier requirements.


14. Limitation of Liability

14.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for wilful misconduct.
14.2. To the fullest extent permitted by law, we shall not be liable for (a) indirect, incidental or consequential losses; (b) loss of profit, revenue, data, goodwill; (c) losses not reasonably foreseeable at the time of contract.
14.3. Except for statutory consumer remedies, our aggregate liability arising out of or in connection with any purchase shall not exceed the amount you paid for the Products giving rise to the claim.


15. Force Majeure

We are not responsible for any delay or failure due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, strikes, labour disputes, governmental actions, failures of suppliers or carriers, or internet/utility outages. We will take reasonable steps to mitigate effects and resume performance as soon as feasible.


16. Privacy & Cookies

16.1. Your personal data is processed in accordance with our Privacy Policy (GDPR-compliant).
16.2. Our cookie usage is described in our Cookie Policy and managed via our consent banner where required by law.


17. Resale & Commercial Use

17.1. Products are sold for personal, household use. Resale or purchase for commercial purposes requires our prior written consent.
17.2. We may cancel orders suspected to be for unauthorised resale.


18. International Customers & Customs

18.1. When ordering for delivery outside the EU, you are the importer of record and must comply with all applicable laws and regulations.
18.2. Customs inspections may cause delays. Any additional customs charges are your responsibility unless explicitly stated otherwise.


19. Complaints, Dispute Resolution & Governing Law

19.1. Contact us first. If you have a complaint, please contact us at [support@kayaceramics.com]. We aim to resolve issues promptly and fairly.
19.2. ADR/ARN (Sweden). If a dispute cannot be resolved, Swedish consumers may refer the matter to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) for non-binding alternative dispute resolution.
19.3. EU ODR platform. EU consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform.
19.4. Governing law & venue. These Terms are governed by Swedish law. For consumers, the courts of your habitual residence may have jurisdiction under mandatory law; otherwise, disputes shall be submitted to the competent courts of Sweden.
19.5. Language. The Site may present these Terms in multiple languages. For Swedish consumers, the Swedish version (if provided) will prevail in case of inconsistency.


20. Changes to the Terms

20.1. We may update these Terms to reflect changes in our practices, legal or regulatory reasons, or improvements to the Site and services.
20.2. The version posted on the Site at the time of your order applies to that purchase. Material changes will be highlighted with a new “Last updated” date.

Appendix B – Returns Instructions (Summary)

  1. Email contact@kayaceramics.com with your order number, item(s), and reason for return (withdrawal, exchange, damaged/incorrect).
  2. Repack items securely, ideally in original packaging, including all inserts and care cards.
  3. Use a tracked service and keep the receipt. You are responsible for the package until it reaches us (unless we provide a prepaid label).
  4. Send to: Kaya Ceramics AB – Returns, Sparbanksvägen 4, 129 32 Hägersten.
  5. Refunds are processed to the original payment method once inspected. Please allow bank processing times.
